Area 53 LLC d/b/a Voltra Mounts – Warranty, Disclaimer & Limitation of Liability

Effective Date: March 1, 2026

Area 53 LLC d/b/a Voltra Mounts ("Voltra Mounts," "we," "us," or "our") manufactures and sells mounting solutions and accessories for fitness equipment, including but not limited to mounts, doublers, and related hardware for use with cable machines and power racks (collectively, the "Products").

By purchasing, installing, or using any Voltra Mounts Product, you acknowledge that you have read, understood, and agree to this Warranty, Disclaimer & Limitation of Liability.

1. Limited Warranty

Voltra Mounts warrants that its Products will be free from defects in materials and workmanship under normal use and service for a period of one (1) year from the date of original purchase by the original end-user purchaser.

This Limited Warranty is non-transferable and applies only to the original purchaser.

What this warranty covers: Defects in materials and workmanship that affect the structural integrity or function of the Product under normal intended use.

What this warranty does NOT cover:

  • Damage resulting from misuse, abuse, negligence, improper installation, failure to follow instructions, unauthorized modifications, or use with incompatible equipment
  • Normal wear and tear, cosmetic damage, or damage from environmental conditions (corrosion, etc.)
  • Products used in commercial gym settings unless expressly approved in writing by Voltra Mounts
  • Any Product that has been altered, repaired, or modified by anyone other than Voltra Mounts
  • Acts of God, accidents, or events beyond our reasonable control

Exclusive Remedy: If a Product proves defective during the warranty period, Voltra Mounts will, at its sole option, repair or replace the defective Product or issue a refund up to the original purchase price paid for that specific Product. This is your sole and exclusive remedy.

To make a warranty claim, contact us at legal@voltramounts.com with proof of purchase and photos/video of the issue. You may be required to return the Product at your expense for inspection.

2. Disclaimer of Warranties

EXCEPT FOR THE LIMITED WARRANTY SET FORTH ABOVE, ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." VOLTRA MOUNTS MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER ARISING BY STATUTE, COURSE OF DEALING, USAGE OF TRADE, OR OTHERWISE.

Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

3. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VOLTRA MOUNTS' TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE OR STRICT LIABILITY), WARRANTY, OR ANY OTHER THEORY, SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO VOLTRA MOUNTS FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL VOLTRA MOUNTS, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, OR SIMILAR DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Personal injury or death
  • Property damage
  • Lost profits or revenue
  • Loss of use or data
  • Cost of substitute products
  • Medical expenses or rehabilitation costs

This limitation applies even if we have been advised of the possibility of such damages and regardless of whether the claim arises from breach of contract, negligence, strict product liability, or any other cause.

4. Assumption of Risk & Release of Liability

Fitness equipment and its mounting hardware involve inherent risks of serious injury, paralysis, or death. These risks include, but are not limited to, equipment failure, improper installation, overloading, misuse, or failure to follow safety instructions.

BY PURCHASING AND/OR USING VOLTRA MOUNTS PRODUCTS, YOU VOLUNTARILY AND KNOWINGLY ASSUME ALL RISKS associated with the installation and use of the Products, including the risk of personal injury or property damage, whether caused by negligence or otherwise.

To the fullest extent permitted by Florida law, you hereby release, waive, discharge, and covenant not to sue Area 53 LLC d/b/a Voltra Mounts, its owners, officers, directors, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to the use or failure of any Product.

5. Proper Installation & Use Required

All Products must be installed and used strictly in accordance with the provided instructions, using the correct hardware, proper torque specifications, and only with compatible equipment. You are solely responsible for verifying compatibility, structural integrity of your rack or mounting surface, and safe usage practices. Failure to do so voids the Limited Warranty and releases Voltra Mounts from liability to the maximum extent permitted by law.

6. Indemnification

You agree to defend, indemnify, and hold harmless Area 53 LLC d/b/a Voltra Mounts and its owners, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use, misuse, or installation of any Product.

7. Governing Law & Venue

This agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any legal action or proceeding arising under this agreement shall be brought exclusively in the state or federal courts located in Manatee County, Florida, and you hereby consent to the personal jurisdiction of such courts.

8. Severability

If any provision of this agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this agreement shall otherwise remain in full force and effect.

9. Entire Agreement

This document, together with our Terms of Service and any product-specific instructions, constitutes the entire agreement between you and Voltra Mounts regarding the subject matter herein and supersedes all prior agreements.
